1. Introduction
Welcome to Kunuleco. These Terms of Service ("Terms") govern your access to and use of the Kunuleco protocol, software, website, and optional centralized components (collectively referred to as "Kunuleco").
Kunuleco is a universal common platform primarily operating on a peer-to-peer (P2P) basis, with optional centralized components. It enables users to manage digital interactions, publish computational objects, create and share content, and connect with services across multiple protocols using a common identity standard.
By accessing or using Kunuleco, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use Kunuleco.
2. Definitions
To ensure clarity throughout these Terms, the following definitions apply:
- "Kunuleco Protocol": The peer-to-peer protocol and software that enables decentralized communication, computation, content sharing, and service integration across multiple protocols.
- "Kunuleco Software": The client software that users install on their devices to participate in the Kunuleco peer-to-peer network.
- "Centralized Components": Optional services and features provided by Kunuleco, Inc. that augment the core peer-to-peer functionality.
- "Website": The official Kunuleco website at www.kunul.eco.
- "User", "you", or "your": Any individual or entity that accesses or uses Kunuleco.
- "We", "us", or "our": Refers to Kunuleco, Inc., the organization that develops and maintains the Kunuleco protocol, software, and optional centralized components.
- "Content": Any information, data, text, software, graphics, messages, tags, or other materials.
- "Computational Objects": Objects that perform computation, execute code, or provide services within the Kunuleco ecosystem.
- "KPAO": Kunuleco Platform Abstraction Objects, which are the standard objects used within the Kunuleco ecosystem.
- "Capsule": Self-hosted platforms within the Kunuleco ecosystem.
- "Community": A group of users that share common interests, purposes, or governance structures within the Kunuleco ecosystem.
- "Reputation Systems": Methods, algorithms, and processes used to calculate, store, and share trust metrics, reputation scores, and attestations about users.
- "Social Bonds": Arrangements where users commit reputation, cryptocurrency, or other value as assurance for their behavior within a community.
- "Community Standards": Rules, norms, and guidelines established by individual communities that govern acceptable behavior, content, and interactions within that community.
3. Peer-to-Peer Nature and Relationship
3.1 Peer-to-Peer Relationship
The Kunuleco Protocol primarily operates on a peer-to-peer basis. This means:
- Users communicate directly with each other without our intermediation
- Content is stored primarily on users' devices
- We do not and cannot monitor, control, or access communications or content exchanged directly between users
- We provide the software that enables these peer-to-peer interactions, but do not provide the communications service itself
3.2 Centralized Components
In addition to the peer-to-peer functionality, we offer optional centralized components:
- These components are provided as an optional service
- Use of these components is subject to additional terms in this agreement
- We maintain more direct control and responsibility for these components
- You are not required to use these components to benefit from the core Kunuleco protocol
4. User Accounts and Registration
4.1 Account Creation
To use certain features of Kunuleco, particularly the optional centralized components, you may need to create an account. When you create an account, you agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
4.2 Identity and Cryptographic Keys
The Kunuleco protocol uses cryptographic keys to establish identity. You are responsible for:
- Securely generating and storing your cryptographic keys
- Backing up your keys to prevent loss
- Managing your digital identity across protocols
We cannot recover lost keys or restore access to your identity if you lose your keys. We strongly recommend implementing secure backup procedures.
5. User Content and Computational Objects
5.1 Content and Object Ownership
You retain ownership of any Content and Computational Objects you create, submit, post, or deploy through Kunuleco. By submitting Content or deploying Computational Objects through Kunuleco, you grant other users and protocols the right to access and interact with them according to your selected privacy, sharing settings, and assigned capabilities.
5.2 Content and Object Responsibility
You are solely responsible for your Content, Computational Objects, and the consequences of sharing them. We do not endorse any Content or Computational Objects or guarantee their accuracy, quality, integrity, or safety. You represent and warrant that:
- You own or have obtained all necessary rights to the Content and Computational Objects you share
- Your Content and Computational Objects do not violate any third party's rights
- Your Content and Computational Objects comply with these Terms and all applicable laws
- Any Computational Objects you deploy are free from malicious code and vulnerabilities to the best of your knowledge
5.3 Prohibited Content and Objects
You agree not to use Kunuleco to create, upload, post, deploy, or transmit any Content or Computational Objects that:
- Violate any applicable law or regulation
- Infringe intellectual property rights
- Contain malicious code, harmful components, or security vulnerabilities
- Are designed to exploit, damage, or gain unauthorized access to other systems
- Harass, threaten, or promote violence against individuals or groups
- Are fraudulent, deceptive, or misleading
- Contain illegal or unauthorized advertising or solicitations
- Are obscene, pornographic, or otherwise objectionable
- Interfere with the operation of Kunuleco or other systems
- Consume excessive computational resources in ways that could harm or disrupt the network
5.4 Content and Computational Objects in Peer-to-Peer Interactions
For Content and Computational Objects shared through peer-to-peer interactions:
- We do not have access to or control over such Content or Computational Objects
- We cannot monitor, moderate, or remove such Content or Computational Objects
- Content and Computational Objects persist according to the rules of the underlying protocols
- Users interacting with your Content or Computational Objects may store, process, or redistribute them according to the assigned capabilities
5.5 Content and Computational Objects in Centralized Components
For Content and Computational Objects submitted to or deployed through our centralized components:
- We may, but are not obligated to, monitor or review such Content and Computational Objects
- We may remove Content or disable Computational Objects that violate these Terms
- We may preserve Content and Computational Objects if required by law
- We will handle your Content and Computational Objects in accordance with our Privacy Policy
6. Object Capabilities and KPAOs
6.1 Object Capabilities
Kunuleco implements an object capability-based security model. By using Kunuleco, you agree:
- To manage capabilities responsibly
- Not to circumvent or undermine capability restrictions
- To respect the capability limitations of objects you interact with
6.2 Kunuleco Platform Abstraction Objects (KPAOs)
KPAOs are the standard objects used within the Kunuleco ecosystem. When creating, sharing, or interacting with KPAOs:
- You grant other users the right to interact with your KPAOs according to the capabilities you assign
- You may restrict access to your KPAOs through capability limitations
- You are responsible for correctly implementing capability restrictions
7. Cryptocurrency Integration
7.1 Third-Party Blockchain Networks
Kunuleco integrates with various cryptocurrency networks. When using these integrations:
- Transactions occur on third-party blockchain networks not controlled by us
- Blockchain transactions are irreversible and we cannot reverse or refund them
- We do not custody your cryptocurrency assets
- Market values fluctuate and we do not guarantee any value
7.2 Wallet Security
You are solely responsible for:
- The security of your cryptocurrency wallet(s)
- Safeguarding private keys and recovery phrases
- Verifying transaction details before confirmation
- Understanding the implications of each transaction
7.3 Compliance with Laws
You agree to comply with all applicable laws regarding cryptocurrency usage in your jurisdiction, including tax reporting requirements.
8. Intellectual Property Rights
8.1 Kunuleco Software
The Kunuleco software is licensed, not sold, to you. Your rights to use the software are governed by the applicable open source licenses, which may include:
- MIT License
- GNU General Public License
- Apache License
These licenses grant you certain rights, including the right to access, modify, and redistribute the code subject to the terms of the applicable license.
8.2 Trademarks
The Kunuleco name, logo, and any other Kunuleco trademarks, service marks, product names, and feature names are trademarks of Kunuleco, Inc. You may not use these marks without our prior written permission.
8.3 Feedback
If you provide feedback about Kunuleco, you grant us a non-exclusive, perpetual, irrevocable, royalty-free license to use that feedback for any purpose without compensation or attribution.
9. Disclaimers and Limitations of Liability
9.1 Disclaimer of Warranties
The Kunuleco protocol, software, and centralized components are provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that Kunuleco will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that Kunuleco is free of viruses or other harmful components.
9.2 Peer-to-Peer Communications Disclaimer
We provide software that enables peer-to-peer communication but do not control or guarantee:
- The behavior or content of other users
- The security or privacy of peer-to-peer interactions
- The availability or reliability of third-party protocols
- The integrity or accuracy of data transmitted between users
9.3 Limitation of Liability
To the maximum extent permitted by law, in no event shall Kunuleco, Inc., its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation damages for loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use Kunuleco
- Any conduct or content of any third party on Kunuleco
- Any content obtained from Kunuleco
- Unauthorized access, use, or alteration of your transmissions or content
In no event shall our total liability to you for all claims exceed the amount paid by you, if any, for accessing centralized components during the 12 months preceding the claim.
10. Communities, Reputation, and Trust Systems
10.1 Community Membership and Standards
10.1.1 Community-Specific Rules
Each community within Kunuleco may establish its own standards, rules, and governance structures. By joining a community, you agree to:
- Abide by that community's specific rules and standards
- Accept the community's moderation and governance decisions
- Understand that community rules may be more restrictive or permissive than our general Terms
- Recognize that community rules may permit or prohibit specific content types based on the community's purpose (e.g., adult content may be permitted in certain communities but prohibited in others)
10.1.2 Community Entry Requirements
Communities may implement various entry requirements, including:
- Minimum reputation thresholds
- Verification of identity or credentials
- Vouching by existing members
- Social bonding or escrow requirements
- Application processes
We do not control these requirements and cannot guarantee entry into any specific community.
10.2 Reputation and Trust Systems
10.2.1 Calculation of Reputation
Kunuleco includes systems for calculating and displaying reputation and trust metrics. These reputation scores may:
- Reflect your behavior, contributions, and interactions within the network
- Incorporate attestations and endorsements from other users
- Vary between different communities and contexts
- Impact your ability to access certain features or communities
10.2.2 Use of Reputation Data
You acknowledge and agree that:
- Your reputation metrics may be visible to other users according to your settings
- Communities and users may make decisions about interacting with you based on these metrics
- Reputation systems are imperfect and may not fully capture your trustworthiness
- We do not guarantee the accuracy or fairness of reputation calculations
10.3 Social Bonds and Enforcement Mechanisms
10.3.1 Social Bonding
Communities may implement social bonding mechanisms, which may include:
- Requiring cryptocurrency or other value to be placed in escrow
- Linking your reputation to that of your vouchers
- Creating mutual accountability systems among members
- Implementing stake-based participation requirements
10.3.2 Enforcement of Standards
Communities may enforce their standards through various mechanisms, including:
- Reputation adjustments and penalties
- Forfeiture of social bonds or escrowed value
- Temporary or permanent exclusion from the community
- Public attestations regarding rule violations
10.3.3 Disputes and Resolution
Disputes related to community standards, reputation, or social bonds:
- Should primarily be resolved through the community's own governance mechanisms
- Are not our responsibility to adjudicate or resolve
- May be subject to the community's own dispute resolution processes
- Cannot be reversed by us in peer-to-peer contexts
10.4 Limitations of Our Role
With respect to communities, reputation systems, and social bonds:
- We provide tools that enable these systems but do not control their implementation
- We are not responsible for the actions, decisions, or policies of individual communities
- We cannot guarantee the fairness or accuracy of reputation calculations
- We cannot reverse reputation changes, bond forfeitures, or community exclusions that occur through peer-to-peer mechanisms
12. Modification of Terms
We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will provide notice through our Website, or by other means, to provide you the opportunity to review the changes before they become effective.
Your continued use of Kunuleco after the effective date of any changes constitutes your acceptance of the modified Terms.
13. Termination
12.1 Termination by You
You may stop using Kunuleco at any time. You may also delete your account for the centralized components if you have created one.
12.2 Termination by Us
We may suspend or terminate your access to centralized components at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
12.3 Effect of Termination
Upon termination:
- Your right to access centralized components will cease
- You may continue to use the Kunuleco Protocol and Software in accordance with the applicable open source licenses
- Content you have shared through peer-to-peer channels may persist according to the rules of those protocols
14. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.
13.2 Dispute Resolution
Any dispute arising from or relating to these Terms or Kunuleco shall be resolved by binding arbitration, except that you may assert claims in small claims court if your claims qualify.
The arbitration will be conducted by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Denver, Colorado, unless you and we both agree to another location. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
13.3 Class Action Waiver
Any arbitration or legal proceeding shall be conducted on an individual basis. Neither you nor we may join or consolidate claims by or against other users, or arbitrate or litigate any claim as a representative or member of a class.
15. General Terms
14.1 Entire Agreement
These Terms constitute the entire agreement between you and us regarding Kunuleco and supersede any prior agreements.
14.2 No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
14.3 Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.
14.4 Assignment
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms without restriction.
14.5 Notice
We may provide notices to you via email, regular mail, or postings on our Website. Notice will be deemed given 24 hours after email is sent or posting is made.
